Reference is made to the Company’s announcement dated 4 February 2016 in relation to the Competition Appeal Tribunal’s decision in favour of AirAsia Berhad, a wholly owned subsidiary of Capital A, against the RM10 million fine imposed by the Malaysia Competition Commission (“MyCC”), and to the announcement dated 10 February 2022 in relation to the decision of the Federal Court dated 9 February 2022 (“Decision”) in dismissing the application by the MyCC for leave to appeal against the Court of Appeal’s decision.

(Unless otherwise stated, the words and abbreviations used herein shall have the same meaning as those defined in the aforesaid announcement.)

On 13 October 2022, AirAsia Berhad received from its external legal counsel a Notice of Motion dated 12 October 2022 filed by the solicitors for MyCC to move the Federal Court to review and set aside its Decision under Rule 137 of the Rules of the Federal Court 1995 (“Review Application”).

In the Decision, the Federal Court had dismissed MyCC’s application for leave to appeal to the Federal Court against the Court of Appeal’s decision of 27 April 2021.

With the dismissal of MyCC’s application for leave to appeal, the Court of Appeal’s decision of 27 April 2021 which overturned MyCC’s decision and the fines imposed against AirAsia Berhad for an alleged infringement of Section 4 the Competition Act 2010, still stands.

The Company firmly and verily believes that the Review Application is without merit and will review the matter with its external legal counsel to resist the same.
